Legislation to Honor Fallen Border Patrol Agent Brian A. Terry Unanimously Passes U.S. Senate

WASHINGTON. D.C. – Upon Tuesday evening’s unanimous passage of the Brian A. Terry Memorial Act , H.R. 2668, from the United States Senate, Representative Darrell Issa (R-CA), the bill’s sponsor, offered the following statement:”All of Washington mourned with the Terry family when Border Patrol Agent Brian Terry gave his life in the line of duty in 2010. Today we stand just as unified for the purpose of honoring and preserving his legacy.”The unanimous support with which the Brian A. Terry Memorial Actpassed the United States Senate is a tribute to Agent Terry’s career of service to our country and to the Border Patrol’s distinguished history of intrepidity and sacrifice for the sake of homeland security.”We recognize that Agent Terry’s untimely passing is a tragedy that never should have happened. And while we continue to pursue answers regarding the circumstances surrounding his death, we resolve that his example of bravery and sacrifice will never be forgotten – especially in the city of Bisbee, AZ where he served.”

The Brian A. Terry Memorial Act, sponsored by Issa with nearly seventy bipartisan cosponsors, will rename the United States Border Patrol Station in Bisbee, AZ to honor the memory of Agent Brian Terry who was gunned down in the line of duty by heavily-armed drug smugglers on December 14, 2010. Terry died the following day. Weapons found at the scene were connected to the Department of Justice’s reckless Fast & Furious Operation.

The Brian A. Terry Memorial Act will be transmitted from the Senate to President Barack Obama for his signature, upon which time the measure will become law.

Hundreds Attend Funeral Service for Border Patrol Agent Brian Terry

DETROIT (WJBK) – Law enforcement officers from around the country converged on Detroit Wednesday to remember a fallen hero.

U.S. Border Patrol Agent Brian Terry died serving his country.

Hundreds of people packed Detroit’s Greater Grace Temple for an emotional funeral service. U.S. Secretary of Homeland Security Janet Napolitano was among the mourners.

It was a surreal and stunning scene outside Greater Grace Temple. Federal agents lined the entrance to the church as the hearse carrying Terry’s body arrived.

Inside bagpipes played as the 40-year-old’s flag-draped coffin was wheeled into place for an emotional funeral and celebration of his life.

“Brian Terry lived and died a hero and a warrior,” said Michigan State Police Sergeant Dan Bowman.

“Brian died protecting others from people that would prey on them,” said Kurt Martin, Terry’s longtime friend.

Terry was shot and killed on December 14 on the United States-Mexico border during a gun battle with a gang known for targeting illegal immigrants and drug smugglers. Four suspects are now in custody. Others are still being sought.

“He knew the dangers of this job, but he went knowing what he was doing made a difference not for himself, but for others,” Martin said.

“We resolve, I resolve, to pursue swift justice for those responsible for his death, and we resolve, I resolve, to do everything in our power to protect those who put their lives on the line every day for our nation’s safety and security,” said Napolitano.

Terry leaves behind his parents, a brother and two sisters, as well as countless men and women in uniform who are vowing to honor his legacy. They have said he was an all or nothing kind of guy who lived life to the fullest and would help in any way he could.

Terry was a 1988 graduate of Flat Rock High School. He served with the Marines and then worked with the Ecorse and Lincoln Park police departments before being hired by the U.S. Border Patrol.

Some of his closest friends spoke during the funeral. One read a passage Terry wrote about himself.

“If today is the day, so be it. If you seek to do battle with me this day, you will receive the best that I am capable of giving,” Bowman said. “You may kill me, but I’m willing to die if necessary. I do not fear death for I have been close enough to it on enough occasions that it no longer concerns me. What I do fear is the loss of my honor and would rather die fighting than have it said that I was without courage.”

Following the funeral, a seemingly endless line of law enforcement vehicles with lights flashing streamed down Seven Mile Road in Detroit. Even as this was taking place, the Justice Department and Mexican authorities were hunting down the rest of the suspects who took this hero’s life.

NDAA 2012 allows for Americans to be indefinitely detained by the military without access to an attorney or a trial by jury on orders of the executive branch. Amendments to exclude American citizens were rejected by the Obama administration and senate vote (See below).

Congress and President Obama have declared war on Americans. The last time America was declared a military zone President Roosevelt authorized the internment of Americans with Executive Order 9066, issued February 19, 1942.

NDAA 2012 is unconstitutional. Sections 1021 and 1022 repeal the 4th, 5th, 6th, 8th, and 14th amendments to the Constitution. The Constitution is the supreme law of the land and declares our right to due process. No law can supersede it. We have a right to our day in court with a jury of our peers.

The trial of all crimes, except in cases of impeachment, shall be by jury; and such trial shall be held in the state where the said crimes shall have been committed.

We will NOT obey any order to detain American citizens as “unlawful enemy combatants” or to subject them to trial by military tribunal.

One of the causes of the American Revolution was the denial of the right to jury trial, the use of admiralty courts (military tribunals) instead, and the application of the laws of war to the colonists. After that experience, and being well aware of the infamous Star Chamber in English history, the Founders ensured that the international laws of war would apply only to foreign enemies, not to the American people. Thus, the Article III Treason Clause establishes the only constitutional form of trial for an American, not serving in the military, who is accused of making war on his own nation. Such a trial for treason must be before a civilian jury, not a tribunal.

The international laws of war do not trump our Bill of Rights. We reject as illegitimate any such claimed power, as did the Supreme Court in Ex Parte Milligan (1865). Any attempt to apply the laws of war to American civilians, under any pretext, such as against domestic “militia” groups the government brands “domestic terrorists,” is an act of war and an act of treason.

Our Declaration of Independence also discusses our right to trial by jury.

Senator Graham said that America is part of the battlefield, and as such, Americans can be captured, interrogated, and killed with no due process. Senators Graham, Kyl, and McCain say the law of war (military law) applies to us.

The senators claim the 2001 AUMF is in accordance with 1971 Non-Detention Act and allows Americans to be detained indefinitely without acces to an attorney. They argue that the Supreme Court has held that the President has the constitutional authority to detain enemy combatants, including U.S. citizens.

No citizen shall be imprisoned or otherwise detained by the United States except pursuant to an Act of Congress

The senators say the act of congress that allows you be detained indefinitely is the AUMF 2001. So, no, the paragraph below from NDAA 2012 Section 1021 does not protect you. We are talking about the law of war applied to American citizens, not criminal law, which includes due process.

tended to limit or expand the authority of the President
or the scope of the Authorization for Use of Military
Force.

It creates the relationship of dependency and trust that experienced interrogators have made clear is critical to persuading terrorist detainees to talk. Navy Vice-Admiral Lowell Jacoby, who at the time was the Director of the Defense Intelligence Agency, explained how military custody is critical to effective interrogation in a declaration that he submitted in the Padilla litigation. He emphasized that successful noncoercive interrogation takes time–and it requires keeping the detainee away from lawyers.

A Tale of Americana, Part II: Sgt. William Ponce

There was a time in my life when I would have said that they were all bad; that even if they started out good the sense of power acquired by holding a monopoly on force must corrupt by it’s very own nature.  At 31 years old, I had never experienced a positive exchange with an officer of the law.  Even small attempts I’d made to reach out such as a smile or kind word never seemed to have much effect with them.  I figured that it was me, that some intrinsic element of mischievousness in my personality must simply make me always appear as if I’m up to no good, or that perhaps my negative experiences were unconsciously causing me to appear as if I wasn’t really being genuine.  Whatever it was, my experiences with police had consistently left me with the feeling that we each regarded the other as somehow less than human and so, although my meeting with Sgt. William Ponce was under a slightly different set of circumstances, I wasn’t quite sure how he would react to me.

With this in mind, I called him ten minutes before our meeting to ask exactly when he would be at our designated meeting place because, as usual, I was running late and was concerned that he wouldn’t react well at being made to wait.  He had gotten a bit lost and I could tell that the tone in his voice was apologetic as he thought I was calling because I was waiting on him.  I had to laugh as I reassured him this wasn’t the case simply because I could already tell that he wasn’t what I had expected; I’m pretty sure he didn’t realize that he had just attained the status of an iconoclast in his own right.

Proper ethics dictate that government employees avoid political involvement while on duty and policy of the Qtown PD reflects the same.  “Internally we’ve been battling with the chief for quite some time” Ponce explains. “We’re not supposed to get involved in politics in any way”.  Unfortunately, this didn’t stop Police Chief Jeff Gilbert from using his officers to target his political enemies.  He claimed it was their responsibility because such people were trying to destroy the town.  Ponce and his officers were explicitly ordered to harass these particular individuals and either cite or arrest them for any and all possible infractions, but much to Gilbert’s dissatisfaction, they refused.

“I feel like I have that obligation…and the day I retire I want to be proud of my service.  I have two little girls and I want them to know what it is to do the right thing”.  Ponce candidly recants how he had wanted to become a police officer since experiencing the effects of domestic violence during his childhood and that it inspired him to want to make a difference.  Originally from Parker, another small town in Arizona located north of Quartzsite, he started his career in law enforcement thirteen years ago at the Maricopa County Madison Street Jail.  Fresh out of the military at the time, he enjoyed that experience and credits it with opening his eyes to certain nuances of human behavior he hadn’t yet seen.  “That’s where I learned about people.  You encounter so many different people and I was honestly still a little naive…You realize that there’s all types and how they each carry themselves” he confides.  He wasn’t kidding, as a graduate of the same school of hard knocks I could sense his artful mastery of the subject matter; the fact that not much gets past him doesn’t make it past me and I’d hazard a guess that Sgt. Ponce is damned good at being a cop.

And what a shame it is when the good are punished for being the good.  Sgt. Ponce and the Quartzsite 10 are now fighting not only corruption but suspension and possible termination from their positions.

“Look where we’re at.  We decided we were going to do this because it’s the right thing, not because we wanted anything….As you know, our careers are on the line, and that’s the sad part.  But we decided that we have to do this because it is the right thing to do.  Not only is Jennifer affected, but the funny thing is the way he [Gilbert] treats the citizens is exactly the way he treats us, and that’s not right.  You can’t treat people that way.  We wanted everyone to know that, hey, he’s doing the same thing to us; we aren’t going to stand for it and neither should you.”

The message of freedom coming from Quartzsite seems to be reaching everyone except the higher ups in the Arizona government who ought to be doing something about it.  In an advanced case of moral agnosticism, everyone from the governor to the attorney general are acting as though it is not their place to intercede.  Perhaps they think if they ignore it it will simply cease to exist.  Or perhaps they mistakenly believe A is B and that there is any excuse at all for government employees to be suspended because they exposed government corruption.  Granted, to any halfway intelligent person, such a concept completely defies rationality,  Therefore this leaves two options: one, that Arizona’s leaders are idiots, or two, that something more insidious is at play.  Although I never estimate the underlying and necessary stupidity of politicians I must unfortunately choose option two.

One possibility has to do with the fact that Quartzsite is smack dab in the middle of something called BLM land.  BLM of course stands for the Bureau of Land Management, the government entity responsible for collecting monies for land sales, maintaining land records, issuing land grants and patents, and other land related bureaucratic activities.  Considering that the BLM is responsible for land patents, which are at the root of what just may be the worst act of fraud ever committed by the United States Government, anything under BLM management is definitely suspect.  Despite inconsistencies in the color coding of this map and legend showing the allocation of land in Arizona, we can narrow the status of Quartzsite down to two possible options.  Along with Parker, it is one of two very small towns that a) consist of BLM land in the middle of a relatively large geographical area made up of nothing else but BLM land or b) are not BLM land but are completely surrounded by BLM land and qualified as “other”.

Either way, the philosophical, sociological, and economic consequences are the same.  There are people who live in Quartzsite, people who have not violated any individual’s rights; good, kind people…are they now relegated to a dismal black abyss as the latest sacrifice to the dark altar of the common good because they just so happen to live on land that the Federal Bureau of Land Management of the United States of America has designated for their own nefarious purposes?  What exactly, whom exactly, is the BLM?  Like any corporation, the BLM is nothing, a zero entity with no rights of its own.  So what on God’s green earth gives them the right to grab land?  Most importantly, since the violation of one individual’s rights equals the violation of all individual rights, are we simply going to stand by and allow the individual citizens of Quartzsite to suffer the indignity of their rights being tread on like dirt, as if they mean nothing at all?

Obviously, the persecution of certain inconvenient individuals began with more than just Police Chief Jeff Gilbert.  According to Sgt. Ponce: “One of my officers told me that during a meeting with a council member he and several other officers explained how they were being directed to target people and the council member stated that the chief had been directed to do so by certain council members because those people were a problem and needed to be dealt with.  Last time I checked I don’t work for the city council.  I work for the police chief and I don’t take my orders from the city council”.  Another sergeant in the Quartzsite PD so happens to be married to the town magistrate who for all intents and purposes serves as town judge; even trying misdemeanor and litigation cases with no actual background in law.   The corruption in Quartzsite is seemingly endless with completely unethical individuals playing positions of power like musical chairs.

“I’m not going to play these games, I’m out here trying to make a difference.  I’m not going to order my officers to do things that I don’t believe are constitutional or lawful….This guy [Gilbert] is tarnishing my honor and the entire reason I became a cop” Ponce tells me.  And despite my negative personal experiences, my years of advocating against police brutality, and even despite the thousands of horrible stories I hear and read about bad cops on a daily basis, I could tell by the tone in his voice that this particular cop is genuinely a good man.

What is it that defines good?  According to Webster’s dictionary, it is defined as “being positive or desirable in nature “.  Is good then a subjective value to be determined by each individual according to what they find desirable?  If that were the case it would mean that there is no such thing as good or evil, that man’s life has no meaning, that there is no existence outside of consciousness; that the world is nothing but an accidental playground of pure, unbridled nihilism and that we are the devil’s children with empty, cackling, infinite nothingness as our total sanction and final purpose.  While looking to any form of mainstream media at various interludes might depict this to be the case, rationality tells us quite differently; and although my overall faith in the human race is sometimes lacking I highly doubt that such a concept accounts for the inner beliefs of anyone but a psychopath.

If good is not subjective – determined by the consciousness of whomever one is asking – is it then intrinsic?  Are certain things simply good in and of themselves, requiring no sanction?  The intrinsic theory of values unfortunately is responsible for almost as many horrors as the ridiculous concept of “public interest” (social theory of ethics).  The intrinsic theory of values provides the logical base for the idea that since certain things are simply good and certain things are simply bad, it doesn’t matter how they are achieved.  For instance: terrorism is bad and safety is good, thus whatever must be done to combat terrorism and guarantee safety must be moral.  According to the intrinsic theory of values, the internment of thousands of Japanese-Americans during World War II was perfectly moral, and according to the intrinsic theory of values it would also be perfectly moral to throw every Muslim on earth in front of a firing squad…or in a gas chamber.

Value cannot be characterized independently of reality nor of consciousness.  It must as fact of matter be a seamless integration of both, using total rational consciousness to build its meaning with the building blocks of reality; primary axioms which exist and their logical corollaries.  This is objective value.  Existence exists, consciousness exists, life exists, and man’s life exists.  As such man’s purpose is to live free, to thrive, and above all, to create.  Good is what forewords life; evil is what spins life out of control to its demise, the concept of irrationality, the idea that life and its corollaries, including principles of non-aggression and self -ownership, do not matter and are not subject to the laws of existence.

What a shame it truly is to punish the good for being the good, and how unfathomably twisted society has become when corruption is rewarded and virtue equals self sacrifice.   Look around, because this is the point at which we have now arrived.  Sgt. Ponce and I chatted about this for awhile before parting ways, each in full agreement that the status quo is completely unacceptable; both ready, albeit from opposite sides of the fence, to do whatever it takes to change it.

Oathkeepers, this rally in Quartzsite, AZ on August 27 is now more than just a march in support of ten oath keeping officers and a stand-up Marine veteran Mayor.

This is going to be a liberty celebration BASH.  (See detailes itinerary below).

After the march in honor of the Quartzsite ten, we will have a big barbeque and then live music on into the night by some excellent local bands and also a live concert by freedom fighter musician JORDAN PAGE.

Jordan is a nationally known superstar in the freedom movement, and a big supporter of Oath Keepers (he often wears an Oath Keepers Tee shirt when he performs). He’s the Thomas Paine of music.  He loves Oath Keepers and is honored to join us for this historic event.

Quartzsite Ten Stand On Their Oath Against Alleged Corruption


On Sunday, July 31, 2011, the Board of Directors of Oath Keepers unanimously voted to call on the Arizona, California, Nevada, New Mexico, Utah, and Montana chapters of Oath Keepers to conduct an official Oath Keepers Muster at Quartzsite, Arizona.  This muster will be held in conjunction with several other patriotic civic organizations, Sons of Liberty Riders, the Sons of Liberty, the Greater Phoenix Tea Party Patriots, the Campaign For Liberty,

The Muster will be held on August 27, 2011.

The purpose of this Muster is to support the courageous stand against alleged corruption within that town’s Police Department by ten police officers of the Quartzsite, Arizona Police Department. The ten officers are currently under “administrative leave,” and at least two of them have been fired from their employment in Quartzsite Police Department. The State’s Attorney General has issued a statement indicating an ongoing State-level investigation, and the County Attorney has issued a statement confirming some of the allegations brought by the whistleblowing officers. Public outcry is at a roar.  It is essential that we support oath keeping officers just as stridently as we call out oath breakers, and here we have ten stellar examples of police officers doing the right thing.  They need our full support, so if you can make this muster, please answer the call.  We have Oath Keepers from as far away as Texas who will be traveling to Quartzsite to join us there to take a stand in support of these officers.

The Muster is also aimed at supporting local patriot/activist Jennifer ‘Jade’ Jones and Quartzsite Mayor Ed Foster, who is a Marine veteran who has kept his oath by standing up for the free speech and political participation rights of the citizens of his town. Oath Keepers intends to spotlight the need for local involvement in local government, transparency in government on all levels, and to encourage unity through community action as small-town America strives for public office accountability in local affairs. America is watching, thanks to the efforts of Jennifer ‘Jade’ Jones, the Quartzsite Ten, and Mayor Ed Foster.

This Muster is to support the Quartzsite Ten and to show public approval of their willingness to speak out at risk of their jobs to seek an independent investigation and the proper and lawful execution of and administration of the law in Quartzsite.

There will be speakers and presentations,  and music after the rally.

The Muster will include an Oath Keepers led march similar to our march at the Tucson Muster this past Memorial Day (May 30, 2011).  We want large, tall marching flags and banners please. Be advised: Southwestern Arizona experiences 100-degree-plus temperatures, so come prepared to handle high heat during our march. We are told that ten or more Phoenix Fire Department EMTs will be volunteering to assist heat victims during the march. We are seeking volunteers who can assist with supplying water along the march route.

At present time we are in process of obtaining permits, establishing locations for the Muster, camping facilities, lodging facilities, etc.  We will be announcing details as they come in and are verified.

NOTE FROM STEWART:According to two eye witnesses, Quartzite Chief of Police Jeff Gilbert referred to the Oath Keepers, the Greater Phoenix Tea Party, and the Sons of Liberty Riders as  “terrorists” during a public “coffee with the Chief” meeting on August 3, 2011.  Reportedly, Chief Gilbert made the reference while discussing the upcoming August 27, 2011 rally that will be carried out by Oath Keepers, the Greater Phoenix Tea Party, and the Sons of Liberty Riders, telling the audience “”I take these terrorist threats very seriously and I have reported them to the FBI and anyone else who will listen.”This was first reported by the Greater Phoenix Tea Party at http://phoenixteaparty.ning.com/profiles/blogs/greater-phoenix-tea-party-haveA public information request has been filed to secure the video and audio of the meeting.   We will then know exactly what he said.  However, given his past behavior, I find the witnesses highly credible.Here is my response to the Chief:

If Chief Gilbert wants to label us “terrorists” simply for keeping our oaths to defend the Constitution, by using our natural right of free speech in support of good police officers who refused unlawful orders, and if he is going to label us “terrorists” for simply exercising our First Amendment protected right to peaceably assemble and petition government for a redress of grievances, — all rights that GOOD MEN fought and died to preserve -  well then, all I have to say is “we’re your huckleberries” Chief.  See you in Quartzsite folks!  Our forefathers are watching.

TOHONO O’ODHAM NATION, Ariz. (KGUN9-TV) – The battle against drug smugglers along the border is getting more sophisticated every day.  Both law enforcement and the criminals they’re hunting use the latest technology to try to stay one step ahead.  But since the early 1970′s, an elite group of Immigration and Customs Enforcement officers have been ancient tribal techniques to track smugglers.

They’re called the Shadow Wolves; they prey on criminals who use the Tohono O’odham Nation to bring their illegal contraband into the country.  The pack of elite hunters were formed in 1974 and are an integral part of protecting the 5,000 square mile Tohono O’Odham Nation–an area roughly the size of the state of Connecticut.

David Scout has been tracking smugglers in the area for nearly two decades. With his M-4 rifle by his side,  Scout admitted to 9 On Your Side work has been getting more dangerous lately.

“Probably within the last ten years I’ve seen a lot more of the suspects that we apprehend at work, they’re carrying a lot more weapons.  Personally I don’t think it’s for law enforcement but there’s always that underlying factor, you never know,” Scout said.  Since the shooting of U.S. Border Patrol agent Brian Terry, Scout said smuggling activity on the reservation has skyrocketed.

“That’s always going to happen because when something like that happens of course what the government is going to do is we’re going to shut that area down and let them know that we’re not going to stand for what’s occurring out there,” Scout said.

KGUN9 News was invited to spend a day with the Shadow Wolves as they hunted down human and drug smugglers.  These officers are highly trained to spot anything unusual in the terrain. Scout is methodical while driving his truck down well known smuggling routes.  In some areas speeds rarely get over ten miles per hour.

“Basically what we’re doing right now is looking for any disturbances, anything that doesn’t look natural,” Scout said.  These tribal tracking techniques have been around for ages. The Shadow Wolves don’t just look for footprints, barbed wire can snag burlap sacks used to carry drugs.  Broken branches and knocked over vegetation can also guide them to the criminals.

As the search went on, Scout found a pair of booties made of blankets. Smugglers typically use the makeshift shoes to hide their tracks. They also ride horses packed with drugs among grazing cattle to blend in. These officers are trained to find anything and can tell if a track made by an animal is unnaturally deep.

Slowly Scout drove through the desert and suddenly he stops, throws his truck in reverse and peers out his window, glaring at what only looks like sand to the untrained eye. Scout opens the door and searches the area.

“Here’s the shoe, right there,” Scout said as he drew a circle in the sand around a seemingly invisible print.  Just by looking at it, he knows it’s at least a few days old, and that whoever left the print is long gone.

Back in the office KGUN9 News spoke to the Shadow Wolves’ supervisor, Assistant Special Agent in Charge Rodney Irby.  9 On Your Side asked him if it’s difficult to keep smugglers from trying to recruit tribal members.

“The socioeconomic reality out here is there is high unemployment and tribal members have always been vulnerable to coercion by the organizations to help them facilitate,” Irby said.

The border on the reservation has almost no infrastructure so it’s a target for drug gangs. Large steel poles alternating from taller to shorter are in place to keep vehicles from driving in to the reservation.

The U.S./Mexico border actually cuts the Tohono O’Odham reservation in two. Tribal members are allowed to drive back and forth freely through specified gates. At these gates there is no port of entry, no fence, and no cameras. The Border Patrol has an agent posted at the gate 24 hours a day looking for anything suspicious.

Law enforcement like the Shadow Wolves are all over the reservation. Seeing several groups of patrol vehicles while driving is common.

KGUN9 News’ hunt with the ShadowWolves turned up empty but their office in Sells has been very successful.  So far this year they’ve seized 6,040 pounds of marijuana.  Last year they nabbed more than 32,000 pounds.

Scout told 9 On Your Side the Shadow Wolves are the best fit for the reservation.  Each member is at least 25% Native American.

“Just being Native American gives me an advantage to be able to communicate and relate to the people,” Scout said.  The heritage, he added, also gives these men an even greater sense of pride to keep the reservation safe.

“I like to do my part you know in protecting the United States from merchandise or narcotics coming through and I try to do my part in keeping that stuff off the streets,” Scout said.

The Shadow Wolves currently have 11 members.  According to Irby they’re getting ready to start recruiting to expand their operations.

Judge John M. Roll: A True American Hero

On January 8, 2011, Federal District Judge John Roll was gunned down by a maniacal coward lunatic. Since this unspeakable and unimaginable tragedy much has been said about who caused this tragedy or who may have prompted its occurrence. Some of this rhetoric bordered on the absurd. I would much rather talk about the good people who had their lives snuffed out before their time and to pay tribute to who they were and what they stood for. Certainly, a beautiful little nine year old angel, named Christina Green, deserves to have her life displayed as an example to others to learn from and enjoy. So, I will do that regarding a man who changed my life and helped alter American history; Judge John M. Roll. He was an honest man and a principled judge. He stood for what he believed was right despite the possible consequences. I met Judge Roll back in 1994, in fact, it was in his courtroom. He was the judge who first heard my lawsuit against the Clinton Administration. Judge Roll had the courage to take a strong stand against the very entity that controlled his salary and career. He actually had the audacity to tell Congress and President Clinton that they exceeded their authority when they made the Brady bill a law.

I was extremely nervous when I walked into Judge Roll’s courtroom. There was a big crowd of supporters and numerous reporters and cameras outside the courthouse. Although I had been to court many times before, this was the first time it was in front of such a crowd of onlookers and the Press and in Federal court. I remember looking at Judge Roll and relaxing somewhat; he was nice looking and rather young, about my age. He had already defended me with at least two pretrial motions that he ruled on, both in my favor. The first one was the Federal Government’s attempt to remove me from the case entirely by claiming I had no standing to sue them in the first place. They argued that only the county’s Board of Supervisors could represent the county in such legal actions. Judge Roll said this was wrong because it was the sheriff being commandeered by the Federal Government, both officially and personally. Next, my lawyer asked for an injunction against the government from being able to arrest me for “failure to comply.” (There was an actual provision in the Brady bill that threatened to arrest the sheriffs if we failed to comply with this unfunded mandate from Congress.) Judge Roll seemed legitimately concerned about this threat throughout the entire lawsuit. Janet Reno herself wrote a memo to the Judge and assured him that the Feds had no intention of arresting me and that the threat of arrest within the language of the Brady bill, was only intended for the gun shop owners, not the sheriffs. Judge Roll, as he announced his decision regarding the injunction said that Janet Reno was not allowed to change the law “by fiat” nor interpret the law for Congress. “Mack’s injunction is hereby granted,” the Judge said calmly and sternly.

Then as the hearing proceeded I was called to the stand. The butterflies returned big time. As the Justice Department’s lawyer cross examined me, she did something unusual; she actually began to address the Judge while I am still sitting on the stand. She said, “why your honor, already in just the first four months of the implementation of the Brady background checks, we have denied over 250,000 felons from gaining access to handguns in this country.” I was thinking to myself what a crock her numbers were and wondering why we had so many felons on the streets all trying to buy handguns in government checked gun shops. Suddenly, Judge Roll interrupted the attorney and rebuked her with, “Counselor, do not pretend in this courtroom that your statistical analysis somehow equates to constitutionality.” I have to say that Roll’s understanding of principles amazed me. He was so professional and knowledgeable. He took his job and the Constitution so seriously. He was truly an exemplary Justice.

When Judge Roll issued his ruling on the Mack v. US case on June 28, 1994, he said two things that absolutely floored me. The first one was the order of the court which summarized his findings:

“The Court finds that in enacting (the Brady bill) Congress exceeded its authority under Article 1, section 8 of the United States Constitution, thereby impermissibly encroaching upon the powers retained by the states pursuant to the Tenth Amendment. The Court further finds that the provision, in conjunction with the criminal sanctions its violation would engender, is unconstitutionally vague under the Fifth Amendment of the United States Constitution.”

Judge Roll, of all the dozens of Judges who had heard this case from me and the other six sheriff defendants, was the only one who ruled that the Brady bill violated the Fifth Amendment as well as the Tenth. It was pursuant to Judge Roll’s insight and sensitivity to the threat this “law” posed to us, the sheriffs, that this case made it all the way to the U.S. Supreme Court.

When I read the other Judge Roll principle, it truly brought me to understand how astonishing this man really was. He said:

“Mack is thus forced to choose between keeping his oath or obeying the act, subjecting himself to possible sanctions.”

To have a federal Judge actually grasp the full extent of my personal motivation for filing this case was absolutely remarkable. He touched my soul with this comment and it is recorded in my books and memory forever. He was truly before his time. Now, his work is a part of American history. His legacy should be one of honesty, courage, and living up to his oath as a true defender of our nation’s rule of law. He changed my life and showed us all that the Constitution is still the supreme law of the land.

Chief Judge John M. Roll of the District of Arizona died on January 8, 2011. He was 63. Judge Roll was one of several victims fatally shot outside a Tucson grocery store during an attack on U.S. Rep. Gabrielle Giffords.
Judge Roll was appointed to the federal bench in 1991 after serving as an Arizona state judge. He also had worked as a state and federal prosecutor. He became chief judge of the district court in 2006.
Flags outside federal courthouses were flown at half staff on January 10, 2011, to honor Judge Roll.

Named Arizona’s chief federal judge in 2006, U.S. District Judge John M. Roll won acclaim for a career as a respected jurist and leader who had pushed to beef up the court’s strained bench to handle a growing number of border crime-related cases. Roll was appointed to the federal bench in 1991 by President George H.W. Bush. He previously served as a state trial judge and as a judge on the mid-level Arizona Court of Appeals, and as a county and state prosecutor. Bishop Gerald Kicanas of the Roman Catholic Church’s Tucson Diocese said Roll was an active parishioner. “He lived his faith as a servant of our nation for the cause of justice,” Kicanas said. Roll was a Pennsylvania native who graduated from the University of Arizona with a bachelor’s degree in 1969; earned a law degree in 1972 at University of Arizona Law College and received his master’s law degree from the University of Virginia Law School in 1990. He is survived by his wife, Maureen; three sons; and five grandchildren.

Service to be Held in AZ for Agent Killed in Shootout

TUCSON, Ariz. (AP) — A public memorial service will be held in Tucson for a U.S. Border Patrol agent killed earlier this month in a shootout with border bandits.

The service for 40-year-old Agent Brian A. Terry will be held at 11 a.m. on Jan. 21 at Kino Stadium in Tucson.

Terry was waiting with three other agents in a remote area north of Nogales on Dec. 14 when a gun battle with the bandits began. Four suspects were arrested.

FBI spokeswoman Susan Herskovits declined to provide details of the investigation.

Bandits have long roamed border areas, robbing and sexually assaulting illegal immigrants as they cross into the country.

A memorial service for Terry was held Dec. 22 in his native Michigan.
